Case History #1
Charges: felony vandalism pursuant to Penal Code § 594(a) and resisting, obstructing and/or delaying police in violation of Penal Code § 148(a)
A man living out of El Segundo was charged with felony vandalism and resisting, obstructing and/or delaying police. According to the El Segundo Police Report, the El Segundo Police Department located at 348 Main Street, El Segundo, CA 90245, received a call indicating that two individuals witnessed a man vandalizing a local apartment complex. The police report indicated that my client had caused over $2,000 of damage.
Generally, vandalism is prosecuted aggressively because it is seen as destructive and disruptive in communities. The prosecutor may also increase charges or, at the very least, allege that the vandalism was done for the benefit of a gang if the vandalism appears to reflect the work of a gong or in any way promises the identity of a gang or “tag crew.”
In my client’s matter however, the alleged vandalism was not gang affiliated. In addition, my client did not have a criminal record. After much negotiation and discussion with the prosecutor and the property owner’s association, I was able to obtain a civil compromise for my client pursuant to Penal Code §§ 1377 and 1378 and the case was dismissed thereafter.
