Charges: Illegal Possession and Transporation of Marijuana

Defending clients who face criminal charges involving controlled substances are a large part of my practice. With the laws relating to marijuana in flux, it is my duty as a criminal defense attorney not only to master the changes in the laws but to continue to be on the cutting edge of how these issues are dealt with by law enforcement in varying cities.

A client living in Manhattan Beach was charged by the Manhattan Beach Police Department located at 420 15th Street, Manhattan Beach, CA with violations of Health & Safety Code §§ 11360(A) and 11357(A). These charges allege illegal transportation of marijuana and possession of more than 28.5 grams of marijuana respectively.

His story was compelling. He worked in manual labor in Manhattan Beach. A few years prior to his arrest by the Manhattan Beach Police Department, he suffered a serious work injury of ruptured discs in his back. After this, he was unable to work in manual labor in Manhattan Beach and continued to endure serious pain in his back.

One remedy he was given by a Manhattan Beach physician was a pain patch, which caused severe lethargy and a sleep disorder. In attempt to subdue these side-effects from the patch, he turned to marijuana. In addition, he had been issued a medical marijuana card from a separate Manhattan Beach physician. On the date of his arrest, my client was transporting marijuana during a temporary time where his medical marijuana card was expired.

After providing the Torrance Deputy District Attorney with documentation supporting the above facts, both charges were dismissed in the interests of justice.
